After Foreclosure Assets: The Institutionalization of Surplus Equity

Prepared for institutional allocators · December 2025 · 27 pages

The research behind the asset class. Why foreclosure no longer means negative equity, what Tyler v. Hennepin County changed, how large the market is, and why 3,000+ fragmented county jurisdictions leave room for institutional infrastructure.

“The AFA market today resembles the Tax Lien market of the 1990s or the Single-Family Rental market of the early 2010s, both of which were dismissed as ‘unscalable’ before becoming multi-billion dollar institutional asset classes.”

Exhibit B

How the money moves

When a foreclosed home sells for more than the debt against it, the difference belongs to the former owner. The county holds it until a claim is filed.

Example · a $300,000 foreclosure sale

$200,000
Debt paid to the lender
$100,000
Surplus equity held by the county

Illustrative figures. Every property, county and fee schedule is different.

Held
1

The sale. The property sells at a foreclosure auction for $300,000.

2

The payoff. The $200,000 debt is paid in full from the sale.

3

The hold. The remaining $100,000 is deposited with the county or court. It is owed to the former homeowner.

4

The acquisition. Milan CM acquires the rights to that claim from the former homeowner.

5

The purchase. Investors buy a portion of a package of claims from Milan CM.

6

The recovery. Milan CM's attorneys file the claim, and the government releases the funds to the attorneys.

7

The disbursement. The attorneys release the proceeds to Milan CM LLC, which deposits each investor’s share into their account on the platform.

Track record: $126M+ recovered across 1,000+ claims in five states over four years.

In their words

Our investors have recorded video testimonials. These are the text versions. Ask for the videos on your call.

At first, I thought it sounded too good to be true, after foreclosure assets? What is that? But after talking with their team and seeing the data, I gave it a shot. A few months in, I’m already seeing real gains. Thanks Milan.

Investor

I’ve been burned by a few investments before, so I came in cautious. But this was different — everything was transparent, and the Milan team actually walked me through everything. Now I’m the one telling my buddies about it.

Investor

I was skeptical about surplus claims assets and Milan — I pictured hidden problems or taking advantage of people. But assets are real, the return made sense, and now I’ve got consistent cash flow. Glad I took the chance.

Investor

It’s rare to find investments that actually deliver on its promise. These claim assets and the numbers check out, and I’m finally building passive income the right way. Can’t thank Milan enough.

Investor

I was a little worried at first, but Milan made everything smooth and transparent. I picked up a bundle of claims and already saw returns within a few months. Couldn’t be happier — it’s been a game changer for my portfolio.

Investor

What I loved most was the built-in upside. The assets were discounted, and priced to win — and that’s exactly what happened. Solid returns, straightforward process, and great support from the Milan team.

Investor

As a newer investor, I didn’t have a huge budget or deep knowledge of foreclosures. This was the perfect entry point. Milan packaged it all in a way that made sense and didn’t overwhelm me. Now I’m confident and reinvesting.

Investor

I’ve always wanted to get into real estate but didn’t want the hassle of flipping or landlording. This investment gave me exposure to real assets without all the work — and my returns so far? Way better than my stock portfolio.

Investor

This isn’t some hype. I ran the numbers, bought the package, and watched the returns roll in. Straightforward and solid.

Investor

I’m fairly new to real estate investing and didn’t know where to start. These guys made it simple — I bought a small asset package, and within a few weeks I was already seeing how the returns worked. Super beginner friendly.

Investor

New to investing? This is how you get in the game without overthinking it. Milan packages the deals, we get the returns.

Pick a state from the ledger. We'll hand you a county's phone number, and the county will confirm the money is real. Counties call it “surplus funds” or “excess proceeds.” Same money, their paperwork.
